    Structured Settlements

Most claimants receiving a settlement award from a personal injury, workers' compensation, or wrongful death case are eligible to place a portion of their settlement proceeds into a structured settlement and receive 100% tax-free and creditor-protected income payments for the duration of the structured settlement annuity. Considering that claimants must make their decision to structure a portion of their settlement prior to receiving their settlement funds from the defendant, it is extremely important to look into all of the available settlement options before the case is finalized. A structured settlement can be funded with as little as $10,000 and utilized to create tax-free lifetime payments, supplement retirement income, pre-fund college plans, cover ongoing medical expenses, pay for health insurance premiums, and much more. Explore the benefits of a structured settlement before jeopardizing special tax consideration afforded to personal injury victims and authorized by the IRS.

    Attorney Fee Deferral Strategies

Structured fees allow attorneys to receive payments over time on a tax-deferred basis (see Childs v. Commissioner, 103 T.C. 634). Much like structuring a claimant’s settlement, structured attorney fees can be customized to meet the needs of the attorney. Payments can be made monthly, quarterly, annually, or in deferred lump sums. Rather than facing the burden of paying tax on the entire fee amount, structured fees are only taxable in the year(s) during which the payments are received. The Settlement Alliance team will help the attorney determine the best possible strategy for meeting financial goals through a structured fee arrangement.

    Government Benefit Preservation

The Settlement Alliance advisors are well versed in government benefit analysis and preservation in every state, an integral part of the settlement planning process. Prior to determining what to do with settlement proceeds it is vital to consider and review any past, current, and potential future eligibility for government benefits and entitlement programs. Because many government benefits vary state by state, only after we have analyzed all available options in a specific state do we move forward with recommending a suitable plan to safeguard valuable benefits.

    Lien Resolution

Failure to resolve pending liens could result in severe penalties and the loss of the settlement recovery. The Settlement Alliance works with attorneys and claimants to resolve matters involving subrogation interests and liens, including Medicare, Medicaid, ERISA/private insurance, VA, and more. Because lien regulations can vary widely from state to state, our team serves as your resource for comprehensive knowledge of the different regulations across the country. We will facilitate the lien resolution process from start to finish, from identifying existing liens and negotiating their resolution to ensuring that all appropriate paperwork is completed in a timely manner.

At times, negotiating the payment of future medical bills can be an essential component of a favorable settlement. If a plaintiff has adequate insurance to cover future medical bills, or if the individual has received a sufficient monetary settlement to be used for those expenses, the federal government may not allow Medicare payments to be distributed for healthcare that is "related" to the tort. However, in the event that the plaintiff's funds are exhausted, Medicare may then be responsible for covering any additional expenses for future injury or illness related to the lawsuit. Attorneys may choose to advise their clients receiving Medicare benefits to "set aside" settlement proceeds in order to ensure funds are available for "related" healthcare.

    Non-Qualified Settlements

Non-qualified settlements are those that do not qualify under IRS guidelines for income tax exclusion. Certain types of non-qualified settlements are eligible for income tax deferral if the proceeds are placed in a structured settlement annuity. If a claimant involved in a non-qualified settlement accepts the proceeds in a lump sum, the entire lump sum could be taxed at the highest applicable state and federal income tax rate. It is reasonable to assume that in many cases, a large lump sum could cause a claimant to be in a higher tax bracket.
